Red Oxygen (“Red Oxygen,” “we,” “us,” or “our”) has prepared this Privacy Policy to explain what personal information we collect, how we use and share that information, and your choices concerning our information practices in connection with our website (the “Site”), as well as all related networks, downloadable software, mobile applications and other services provided by us and on or through which a link to this Privacy Policy is displayed (collectively, together with the Site, our “Service”). This Privacy Policy is incorporated into and forms part of our Terms and Conditions.
Red Oxygen is committed to adopting the highest standards to safeguard our customer’s personal information:
Like all companies operating in Australia, we are bound by the National Privacy Principles as set out in the Privacy Act 1988 (Cth) and the Privacy Amendment (Private Sector) Act 2000.
For residents of the United States, Red Oxygen complies with the provisions and obligations imposed by applicable Data Protection Legislation if applicable, which may include state-based privacy laws such as the California Consumer Privacy Act (“CCPA”) as amended by the California Privacy Rights Act (“CPRA”) and/or the Colorado Privacy Act (“CPA”).
Additionally, our privacy practices are designed to provide high level international standards for the protection of your personal data, including compliance with the European Union’s General Data Protection Regulation (GDPR).
Personal Information
We know that you are concerned about your privacy, so is Red Oxygen, and it is our intent to keep your information safe and secure. Unless you consent, we will not disclose your personal information to third parties, other than those who have contracted with Red Oxygen to keep the information confidential, or who are subject to obligations to protect your personal information. Red Oxygen does not share or sell your personal information to third parties for marketing purposes, for the purposes of lead generation, or for purposes of third-party analytics. No mobile information, including text messaging originator opt-in consent data, will be sold or shared with third parties for promotional or marketing purposes. The only exception to this would be to meet specific court-mandated legal requirements, or any law, rule, legal decision or regulation with which we are legally obliged to comply.
What Information We Collect
We collect information from our clients when they use our services. Our clients may also provide us with personal information relating to their customers or other contacts when they use our services to send message communications.
In this section we explain the different types of personal information (“Personal Information”) that we may collect or hold in relation to you, depending on whether you are a client, or a customer or other contact of one of our clients:
- If you are a user from one of our client organizations, we store your contact information (name, postal address, telephone, fax number, and email address) when you enter that information online either through our website or client portal. If you have signed any documents with us, we may also store your signature. And, at times we may collect your demographic information like age, gender and income level.
- If you are a client that has chosen to pay for our services by credit card or direct debit, then we collect your credit card or bank account details when you provide these for payment purposes (and please note that we do not store your credit card information; we substitute your credit card information with a PCI compliant token to safeguard your details and provide you with maximum security);
- Other details relating to the company or organization that you are an employee of, or are administering the Red Oxygen account on behalf of, if that information is reasonably necessary for our activities.
- If one of our clients has sent you a message communication using our services, or you have responded to a message communication from one of our clients, then our client will have provided us with your contact details, which may include your name, postal address, telephone, mobile and fax numbers and email addresses.
- We may also store Personal Information that our clients have collected from other contacts and uploaded to our online portal, API or mobile application.
- If you contact us through our website, online portal, or by email, fax, post or telephone, we will retain your Personal Information that you provide to us, together with the content of our mutual correspondence, including any emails you send to us.
- If you have requested a trial of our services, our sales team will collect contact information (name, address, telephone number, email address) from you over the telephone or via our website or by email.
Internet Activity Information: When you visit, use, and interact with the Service, we may receive certain information about your visit, use, or interactions. For example, we may monitor the number of people that visit the Service, peak hours of visits, which page(s) are visited, the domains our visitors come from (e.g., google.com, yahoo.com, etc.), and which browsers people use to access the Service (e.g., Chrome, Firefox, Edge, etc.), broad geographical information, and navigation pattern. In particular, the following information is created and automatically logged in our systems:
- Log Information: Information that your browser automatically sends whenever you visit the Site. Log Information includes your Internet Protocol address, browser type and settings, the date and time of your request, and how you interacted with the Site.
- Cookies Information: Please see the “Cookies” section below to learn more about how we use cookies.
- Device Information: Includes name of the device, operating system, and browser you are using. Information collected may depend on the type of device you use and its settings.
- Usage Information: We collect information about how you use our Service, such as the types of content that you view or engage with, the features you use, the actions you take, and the time, frequency, and duration of your activities.
- Location Information: We derive a rough estimate of your location from your IP address.
- Email Open/Click Information: We use pixels in our email campaigns that allow us to collect your email and IP address as well as the date and time you open an email or click on any links in the email.
The redoxygen.com and redoxygen.net websites are maintained by Red Oxygen.
How we use your Personal Information
We use Personal Information to provide quality messaging services to our clients. We may use your Personal Information in some or all of the following ways:
- To provide you with access to our website or online portal.
- To provide our products and services to you, including as a recipient or end user of our messaging services.
- To train our staff and personnel who may have interaction with customers or message recipients, or access to customer or message recipient data.
- To process payments and carry out business administration in relation to your client account.
- To respond to any correspondence from you, including handling any complaints from you.
- To verify your identity and for the process of detecting, investigating and preventing fraud.
- Through the use of analytics software (including Google Analytics Demographics, Interest Reporting and third party audience data) to assess and improve the operation and performance of our website and our mobile application, and to understand how users find and use our website.
- To analyze your use of our various services (including product usage, system and log files) to improve the performance and development of our messaging products.
- To comply with any law, rule, legal decision or regulation that we are obliged to comply with.
We use your Personal Information for the purpose of performing our contract with you or where we have your consent to do so.
If you do not provide us with the Personal Information we request, we may be unable to provide you with the products or services you are seeking.
Marketing: We may use your personal information to contact you to tell you about products or services we believe may be of interest to you. For instance, if you elect to provide your email or telephone number, we may use that information to send you special offers. You may opt out, unsubscribe or contact us with a removal request at any time. If you unsubscribe from our marketing lists, you will no longer receive marketing communications but we will continue to contact you regarding management of your account, other administrative matters, and to respond to your requests.
Cookies: We may use cookies to operate and administer our Site, gather usage data on our Site, and improve your experience on it. A “cookie” is a piece of information sent to your browser by a website you visit. Most web browsers, you will find a “help” section on the toolbar. Please refer to this section for information on how to receive a notification when you are receiving a new cookie and how to turn cookies off.
Please note that if you limit the ability of websites to set cookies, you may be unable to access certain parts of the Site and you may not be able to benefit from the full functionality of the Site.
If you access the Site on your mobile device, you may not be able to control tracking technologies through the settings.
We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help us analyze how users use the Site and enhance your experience when you use the Site.
Information Security and Quality
We intend to protect the quality and integrity of your personally identifiable information. We have implemented appropriate technical and organizational measures to help us keep your information secure, accurate, current, and complete.
We will make a sincere effort to respond in a timely manner to your requests to correct inaccuracies in your personal information. To correct inaccuracies in your personal information please return the message containing the inaccuracies to the sender with credible details of the correction requested.
Red Oxygen does not sell your personal information.
We only share the categories of personal information described above without further notice to you, when required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, including to meet national security or law enforcement requirements, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the Service, or the public, or (v) protect against legal liability.
You use the Service at your own risk. We implement commercially reasonable technical, administrative, and organizational measures to protect personal information both online and offline from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or email transmission is ever fully secure or error free. Take special care in deciding what information you send to us via the Service or email. Please keep this in mind when disclosing any personal information to Red Oxygen via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third party websites.
Third Party Site Links
The Service may contain links to other websites not operated or controlled by us, including social media services (“Third Party Sites”). The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third Party Sites directly for information on their privacy practices and policies.
Personalized URL link
On occasion, Red Oxygen presents a personalized URL (link) that brings the visitor to a personalized web page. Such a personal URL is readily identifiable and by clicking on that link and going to a personal web page you are agreeing to let Red Oxygen collect information about your session visits. We use this information to help us provide you with information that matches your interests. If you do not wish information to be used in this way, simply do not click on such personalized URLs.
Children’s Data
Protecting the privacy of children is especially important. Red Oxygen’s website is not directed towards children, and we are committed to comply with applicable laws and requirements to protect children from online harassment. All customers and users of the Red Oxygen service are required to be 18 years or older.
CompleteSMS for Outlook Specific Information
Red Oxygen’s CompleteSMS for Outlook add-in adds ‘Send SMS’ and ‘Reply via SMS’ options to the email context menu. The add-in utilizes Microsoft OAuth (Open Authorization), and requires access to the user’s Red Oxygen email address to authorize you to use CompleteSMS. We do not ask for the users’ personal information such as their Outlook account password. The add-in does request certain permissions from the user in order to run the add-in:
- Read your calendars
- Read your contacts
- Maintain access to data you have given the add-in access to
- Read your profile
- Read all groups
Once the user has successfully been granted permission, the user’s information is retained as a part of the OAuth session. This is stored so that the user will be seamlessly connected every time they use the add-in. Red Oxygen’s CompleteSMS for Outlook stores data within the application or browser’s memory, but this data is not accessible once the user logs out from their Microsoft account or refreshes the browser window.
Note: We do not ask for the user’s personal Microsoft account information.
GmailSMS-Specific Information
Red Oxygen’s GmailSMS embeds a “Send SMS” button into the Gmail user interface, to allow the sending and receiving of text messages using your Red Oxygen account directly from within Gmail. In order to send messages from Gmail, Red Oxygen’s SendSMS.dll requires access to the user’s Red Oxygen account information (such as their email address, Red Oxygen password & their phone number) when the user is initially installing the add-on into their Gmail account. We do not ask for the user’s personal information such as their Gmail Account Password. GmailSMS does request certain permissions from the user in order to run the add-on:
- Read/write access to Contacts and Contact Groups.
- Read-only access to Contacts and Contact Groups.
- Sending of messages only. No read or modify privileges to the mailbox.
- Manage drafts and send emails.
Once the user has successfully been granted permission, the user’s Red Oxygen account information is stored in Chrome’s storage. This information is stored so that the user does not need to verify their account every time they use the GmailSMS add-on. Red Oxygen’s GmailSMS stores data within the browser’s memory, but this data is not accessible once the user logs out from their Gmail account or refreshes the browser window.
Note: We do not ask for the user’s personal Gmail account information.
Notification of Changes
The Service and our business may change from time to time. As a result, we may change this Privacy Policy at any time. When we do, we will post an updated version on this page, unless another type of notice is required by the applicable law. By continuing to use our Service or providing us with personal information after we have posted an updated Privacy Policy, or notified you by other means if applicable, you consent to the revised Privacy Policy and practices described in it.
